In a courtroom statement, Luis Rubiales claimed that Spanish footballer Jenni Hermoso consented to the kiss he gave her following the 2023 Women’s World Cup final.

The former president of the Royal Spanish Football Federation (RFEF) faces charges of sexual assault and is accused of pressuring Hermoso to publicly state that the kiss was consensual.

During his testimony at Spain’s National Court in Madrid, Mr. Rubiales expressed that he was “absolutely sure” the player gave her approval for the kiss, asserting, “It was a completely spontaneous moment.”

This incident occurred during the medal ceremony after Spain emerged victorious in the World Cup held in Australia, which sparked protests and demands for Rubiales’s resignation. He continues to deny any criminal conduct.

While providing evidence, Mr. Rubiales described the kiss as “an affectionate gesture.”

He remarked, “This was an incredible moment for her. We were both expressing gratitude, and she embraced me tightly. I asked her if I could kiss her, and she agreed.”

He further stated, “I held onto her to prevent myself from stumbling.”

When questioned about his precise wording regarding the kiss, Rubiales admitted he could not recall exactly but thought it might have been a “little kiss.”

He acknowledged his awareness of protocols against sexual harassment and violence.

Conversely, Ms. Hermoso previously informed the court that she had never granted permission for the kiss, describing the event as having “tainted one of the happiest days of my life.” Read more here.

A lip-reading expert testified in court, indicating that Mr. Rubiales asked Ms. Hermoso, “Can I give you a kiss?” as seen in video footage, though her face was not visible.

Mr. Rubiales admitted to “making a mistake” during the podium incident, conceding that his actions “were not appropriate” and noted he should have maintained a more professional demeanor. Nonetheless, he denied committing any offense.

In September 2023, Mr. Rubiales resigned after FIFA suspended him and Spanish authorities initiated an investigation.

Additionally, three of his former colleagues face trial for allegedly conspiring to pressure Hermoso: Jorge Vilda, the coach of the victorious World Cup team; Rubén Rivera, the RFEF’s former marketing chief; and Albert Luque, the former sporting director.

All four defendants maintain their innocence regarding the charges. Prosecutors are seeking a sentence of two and a half years in prison for Rubiales. The trial is ongoing and is set to continue until February 19.
